1. Acceptance of Terms

Welcome to BeyondlyAI. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and BeyondlyAI ("we," "our," or "us") governing your access to and use of the BeyondlyAI mobile application, website, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

If you are accessing the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

To use the Service, you must:

• Be at least 13 years of age (or 16 in the European Economic Area)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law

If you are under 18 years of age, you must have the consent of a parent or legal guardian to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Description of the Service

BeyondlyAI is an AI-powered ingredient intelligence and wellness platform. The Service includes, but is not limited to, the following features:

• Ingredient Scanner: Scan product barcodes or photograph food labels to receive AI-powered ingredient analysis, health scores, allergen warnings, and alternative product suggestions
• Calorie and Nutrition Tracking: Log meals via text description, photo, or barcode scan to track daily calorie intake, macronutrients, and meal types
• Personalized Meal Plans: AI-generated weekly meal plans tailored to your dietary preferences, fitness goals, allergies, and calorie targets
• Personalized Workout Plans: AI-generated workout programs with guided exercises, adaptive feedback, and progress tracking
• Daily Pattern Insights: AI-powered analysis of your eating and fitness habits to identify patterns such as stress eating, sugar spikes, and workout inconsistencies
• Health Analytics: Visual dashboards tracking your nutrition trends, workout consistency, and goal progress

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service or any part thereof.

4. User Accounts

4.1 Account Creation

You may create an account using your email address and password, or by authenticating through a supported third-party provider (Google or Apple). You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at hello@beyondlyai.com if you become aware of any unauthorized use of your account or any other breach of security.

4.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent usage limits, abuse free trials, or for any other deceptive purpose is prohibited and may result in immediate termination of all associated accounts.

5. Subscriptions and Payments

5.1 Subscription Plans

BeyondlyAI offers a free trial tier and a paid Pro subscription. Current pricing and feature limits are displayed on our website and within the app. We reserve the right to change pricing at any time, with reasonable notice provided to existing subscribers.

5.2 Billing and Renewal

Pro subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us (or our payment processors) to charge your chosen payment method at the beginning of each billing cycle. Subscriptions automatically renew unless cancelled before the end of the current billing period.

5.3 Payment Processing

Payments on the web are processed by Stripe. Payments on iOS are processed through Apple In-App Purchases. We do not directly store your credit card numbers or full payment credentials. All payment data is handled by these third-party processors in accordance with their respective terms and privacy policies.

5.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds will be issued for partial billing periods.

• Web subscriptions: Cancel directly through the "Manage Subscription" button in your account Settings page. This opens the Stripe Customer Portal where you can cancel your subscription, update your payment method, and view your billing history — all self-service with no need to contact us. If you are unable to access the portal for any reason, you may contact us at hello@beyondlyai.com as a fallback
• iOS subscriptions: Cancel through the Apple App Store subscription management in your device Settings (Settings > Apple ID > Subscriptions). Per Apple's policies, refund requests for iOS purchases must be directed to Apple

5.5 Refund Policy

For web subscriptions processed through Stripe, refund requests may be submitted to hello@beyondlyai.com within 14 days of the initial purchase. Refunds are granted at our sole discretion. For iOS In-App Purchases, all refund requests must be submitted directly to Apple in accordance with their refund policies.

6. Free Trial

New users receive a 14-day free trial upon account creation. The free trial provides limited access to the Service's features as described on our pricing page.

• The free trial begins automatically upon account creation and does not require payment information
• Usage limits during the trial apply to the entire 14-day period (not per-month)
• When the trial expires, you must subscribe to the Pro plan to continue using limited features
• Free trial offers are limited to one per person. Creating multiple accounts to obtain additional trials is a violation of these Terms

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems and infrastructure
• Interfere with, disrupt, or place an undue burden on the Service or its underlying infrastructure
• Use automated systems, bots, scrapers, or similar tools to access the Service without our express written permission
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
• Circumvent, disable, or interfere with usage limits, authentication mechanisms, or other security features
• Create multiple accounts to abuse free trial offers or usage limits
• Resell, redistribute, or make the Service available to third parties without authorization
• Submit false, misleading, or fraudulent information to the Service
• Use the Service to generate content that is harmful, abusive, threatening, or that violates the rights of others

We reserve the right to investigate and take appropriate action against anyone who violates these restrictions, including suspending or terminating their account and reporting them to law enforcement.

8. AI-Generated Content and Health Disclaimer

8.1 AI Limitations

The Service uses artificial intelligence (powered by third-party AI providers) to generate ingredient analyses, health scores, meal plans, workout plans, daily insights, and recommendations. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or omissions
• Ingredient analysis results are based on available data and AI interpretation, which may not reflect the complete or current formulation of a product
• Calorie estimates, macronutrient calculations, and health scores are approximations and should not be treated as precise medical measurements
• Meal plans and workout plans are generated based on the information you provide and general nutritional/fitness guidelines; they are not personalized medical prescriptions
• The Service may not detect all allergens, harmful ingredients, or ingredient interactions
• You are solely responsible for verifying any information provided by the Service before acting on it

8.2 No Medical Advice

Nothing in the Service constitutes professional medical advice, diagnosis, or treatment. The information provided should not be used as a substitute for professional medical advice. If you have or suspect you have a medical condition, food allergy, or dietary restriction, consult a healthcare professional before using the Service's recommendations. Individual nutritional needs and responses to ingredients vary widely. Reliance on any information provided by the Service is solely at your own risk.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including all content, features, functionality, software, design, text, graphics, logos, icons, and the arrangement thereof (excluding User Content and third-party product data), is the exclusive property of BeyondlyAI and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works of any part of the Service without our express written consent.

9.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include the right to:

• Modify or copy the Service's software or content
• Use the Service for any commercial purpose without our written consent
• Use data mining, robots, or similar data gathering or extraction methods on the Service
• Download or cache any material from the Service except as explicitly permitted

9.3 Product Data

Product information displayed in the Service (names, brands, ingredients, nutrition facts) may originate from public databases such as Open Food Facts, which is licensed under the Open Database License (ODbL). Product data remains subject to its original licensing terms and ownership by the respective manufacturers and data sources.

10. User Content and Data

10.1 Your Data

You retain ownership of the personal data, fitness goals, dietary preferences, food logs, and other information you provide to the Service ("User Content"). By using the Service, you grant us a limited license to use, process, and store your User Content solely for the purpose of providing, improving, and personalizing the Service as described in our Privacy Policy.

10.2 AI Processing

By using AI-powered features, you consent to your relevant data (such as food logs, dietary preferences, and fitness goals) being sent to our third-party AI providers for processing. Your personal identity is not included in AI analysis requests. Our AI providers process data in accordance with their respective privacy policies and do not use your data to train their models.

10.3 Data Accuracy

You are responsible for the accuracy of the information you provide to the Service. Inaccurate data (such as incorrect weight, height, or calorie entries) will result in inaccurate AI-generated recommendations. We are not responsible for outcomes resulting from incorrect or incomplete user data.

The Service integrates with and relies upon the following third-party services. Your use of the Service constitutes acknowledgment that these third-party services have their own terms and privacy policies:

• Supabase: Database hosting and authentication
• Anthropic (Claude AI): AI-powered ingredient analysis, meal plans, workout plans, and insights
• Open Food Facts: Product barcode and nutritional database
• Stripe: Web payment processing
• Apple / RevenueCat: iOS In-App Purchase management
• Google OAuth / Apple OAuth: Third-party authentication
• Vercel: Hosting and privacy-friendly analytics
• Sentry: Error tracking and crash reporting

We are not responsible for the availability, accuracy, or practices of any third-party services. Your interactions with third-party services are governed by their respective terms of service and privacy policies. We encourage you to review them.

12. Termination and Account Deletion

12.1 Termination by You

You may stop using the Service at any time. You may request deletion of your account and all associated personal data through the app's account settings or by contacting us at hello@beyondlyai.com. Upon account deletion, all your personal data — including your profile, fitness goals, scan history, calorie logs, meal plans, and workout data — will be permanently removed from our systems.

12.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion:

• Violates these Terms or any applicable law
• Is harmful to other users, third parties, or our business interests
• Involves fraudulent, deceptive, or abusive activity

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply after termination.

You agree to indemnify, defend, and hold harmless BeyondlyAI, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that your use of the Service caused damage to a third party.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the United States.

16.2 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact us at hello@beyondlyai.com and attempt to resolve the dispute informally for at least 30 days.

16.3 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice through the app (such as an in-app notification or banner). Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
